Terms & Conditions

Last updated: 03/11/2026

These terms apply when you use this website or engage Websedia. Please read them carefully, especially sections 8, 9 and 15, which limit what we promise and our liability.

2. Definitions

“Client” or “you” means the person or business that engages us. “Services” means our health and safety consultancy work, including risk assessments, audits, inspections, policy documents, training, incident investigations, emergency planning and Project Supervisor services. “Deliverables” means the reports and documents we produce for you.

3. Using this website

You may use this website for lawful purposes only. You must not interfere with its security or operation, or use it to send harmful or misleading content.

Website content is general information. It is not legal advice or advice about your specific workplace, and it may not reflect the latest change in the law. We do not promise that the website will be uninterrupted or error-free. We are not responsible for third-party websites that we link to.

4. How an engagement starts

Submitting an enquiry or booking a consultation does not create a contract for Services. A contract starts when you accept our written quote or proposal, and we confirm it in writing or start work with your agreement.

The quote or proposal sets out the scope, deliverables, fees and any timescale. If it conflicts with these terms, the quote or proposal applies. Work outside the agreed scope needs written agreement and may cost extra.

5. Fees and payment

We provide fixed-fee quotes unless we agree otherwise. Quotes are valid for 30 days and exclude VAT and third-party costs unless stated.

We may require a deposit before starting work. Urgent and same-day work may require full payment in advance. Other invoices are due within the stipulated time period on the invoice.

If you pay late, we may charge interest at the rate allowed by law, recover reasonable collection costs and suspend the Services after giving written notice. We may hold back final Deliverables until overdue amounts are paid, unless the law requires otherwise.

6. Timescales

Delivery times, including 24-hour policy delivery and 24 to 48-hour visits, are targets and not guarantees. They depend on the scope, our availability and receiving complete information from you. Where a deadline is critical, we must confirm it in writing.

7. Your responsibilities

You must:

  • give us complete, accurate and timely information
  • tell us about relevant hazards, incidents, changes and correspondence from the authorities
  • give us safe access to sites, people and records
  • get any permission needed for us to access a site or receive personal data
  • implement our recommendations and keep your documents up to date
  • tell us promptly about changes that could affect our work

We rely on the information you give us and may not verify it. We may delay work or charge extra if your actions or missing information affect the Services. You may authorise us to carry out unannounced site visits as part of an agreed inspection service.

8. Scope and limits of our Services

Your duties stay yours. Engaging us does not transfer your duties as an employer, client, contractor, duty holder or occupier. You remain responsible for managing your workplace, supervising your people and carrying out corrective action.

No guaranteed outcome. We work with reasonable skill and care. We do not guarantee that you will avoid an inspection, fine, stop-work order, prosecution, claim or accident. We also do not guarantee that an authority will accept a document or lift an enforcement action. Those decisions belong to the authorities.

Point-in-time findings. Reports reflect the conditions, activities, legislation and information available when we did the work. They do not cover hidden hazards, areas we could not access or later changes. Operations, sites and laws change, so documents need regular review.

Not legal advice. Our Services are health and safety consultancy. We are not a law firm and do not provide legal representation. Take independent legal advice for prosecutions, claims and appeals.

Dealing with authorities. We may communicate with an authority on your behalf only where you have authorised us to. We may also make any report that the law requires of us.

No constant presence. Unless agreed in writing, we are not on site full time, and we do not control your workers, contractors or methods of work.

Certification. Unless the proposal says otherwise, our Deliverables are reports and not certificates. Any certification through a third party depends on that party’s requirements and availability.

9. Project Supervisor services

We act as Project Supervisor only under a separate written appointment. It sets out the project, the stages covered and our role under the Health and Safety at Work (Minimum Health and Safety Requirements for Work at Construction Sites) Regulations (S.L. 646.27).

The appointment does not relieve the client, contractors or others of their own legal duties. You must give us the project information, access, authority and contractor cooperation needed to perform the role. You must not start or continue work without any notification or documentation that the law requires.

We may ask for unsafe work to be stopped, and we may report matters where the law requires it. If our appointment ends, you must appoint a replacement promptly. We may tell the relevant authority that our appointment has ended.

10. Training

Training dates, venues and attendee numbers are agreed in advance. You must make sure attendees are fit to take part and give us accurate attendee details. Training supports competence, but it does not replace your duty to instruct and supervise workers. Fire training or third-party certification is subject to the third party’s terms and availability.

11. Changes and cancellations

You can reschedule or cancel a booked visit or training session without charge by giving at least 48 hours’ written notice. With shorter notice, we may charge 50% of the fee for that booking, plus any costs already incurred.

We may reschedule because of illness, unsafe conditions or events beyond our control. If this happens, we will offer a new date or refund the amount paid for that undelivered booking.

12. Ending an engagement

Either party may end an ongoing Service by giving 30 days’ written notice, unless the proposal says otherwise. Either party may end it immediately if the other seriously breaches these terms and does not fix the breach within 14 days of written notice.

We may also stop work immediately if you ask us to act unlawfully, if continuing would put people at risk, or if you do not pay. You must pay for work completed up to the end date. Project Supervisor appointments may need a longer handover period.

13. Intellectual property

We keep the intellectual property in our Deliverables, templates, training materials and methods. Website content belongs to us or our licensors.

Once you have paid in full, you may use the Deliverables for your internal business and compliance purposes, and share them with authorities, insurers and your advisers. Do not resell or publish them, or adapt them for another site or project, without our written permission.

14. Confidentiality and data protection

Each party must keep the other’s confidential information private and use it only for the engagement. This does not apply to information that is public, or that must be disclosed by law, a court or an authority.

Our Privacy Policy explains how we handle personal data. Where we process personal data on your behalf, you are the controller and we are your processor. In that case we will:

  • process the data only on your documented instructions, unless the law requires otherwise
  • keep it confidential and protected by appropriate security
  • use a sub-processor only under equivalent written obligations, and tell you about changes
  • help you with data subject requests, security and breach duties
  • delete or return the data when the engagement ends, unless the law requires us to keep it
  • provide information reasonably needed to show compliance

You must have a lawful basis for sharing the data and must share only what is necessary.

15. Liability

Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, wilful misconduct, gross negligence, or anything else that cannot legally be limited.

We are not liable for loss of profit, revenue, business or opportunity, or for indirect or consequential loss. This includes delays, stop-work orders and fines to the extent they are caused by your acts or omissions, your contractors, incomplete information or a failure to follow our recommendations. Deliverables are for you alone, and we owe no duty to anyone else who relies on them without our written agreement.

You must tell us about any claim within 12 months of becoming aware of it, unless the law gives you longer.

16. Events beyond our control

Neither party is liable for a delay or failure caused by events beyond its reasonable control, such as severe weather, illness, utility failure, or action by an authority. Payment obligations continue for work already done.

17. Consumers

These Services are mainly for businesses. If you are a consumer, such as a homeowner engaging us for personal reasons, your mandatory consumer rights under Maltese law apply and nothing in these terms affects them.

This may include a 14-day right to cancel a contract made at a distance or away from business premises. If you ask us to start during that period, you may have to pay for the work done before you cancel. You may lose the right to cancel once the Service has been fully performed.

18. General

We may use subcontractors but remain responsible for their work under the engagement. You may not transfer your rights under these terms without our written consent. If part of these terms is unenforceable, the rest continues. A delay in enforcing a right does not waive it.

These terms and the quote or proposal are the whole agreement between us for the engagement. We may update these terms, and the version in force when your engagement starts will apply to it. Changes to a live engagement must be agreed in writing.

19. Complaints, governing law and contact

Please send complaints to info@websedia.com, and we will try to resolve them promptly. These terms are governed by the laws of Malta. The courts of Malta have jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.
